Terms and Conditions for Electrical Installation and EV Charge Point Services
1. General Terms
1.1 These Terms and Conditions (“Terms”) govern the provision of electrical installation and EV charge point installation services by, London EV Chargers a company registered in England with its registered office at 85 Great Portland Street, London, W1W 7LT
1.2 By engaging the Company to perform Services, the Client agrees to these Terms in full. Any modifications to these Terms are valid only if agreed to in writing by both parties.
1.3 These Terms apply to all Clients, including residential, commercial, and industrial Clients.
2. Scope of Services
2.1 London EV Chargers specialises in providing electrical installation and maintenance services, including the installation of EV charge points for domestic, commercial, and industrial premises.
2.2 The scope of Services will be agreed upon in a written contract with the Client, specifying the work, timeline, and fees.
2.3 All Services are subject to availability, and the Company reserves the right to decline any project without providing a reason.
3. Client Responsibilities and Site Preparation
3.1 The Client is responsible for removing all stock, fixings, fittings, valuable objects, and any obstructions that may impede the Company’s engineers. London EV Chargers will not be liable for damage caused to any items not removed before installation.
3.2 The Client must advise the Company of any concealed water, gas, electrical, telephone, or other services on-site before installation begins. London EV Chargers accepts no liability for damage to any such services or consequential losses due to undisclosed or hidden services.
3.3 This quotation does not include the cost of hiring cranes, scaffolding, or towers needed for component lifting or positioning. If required, these must be arranged by the Client, or the Company will provide them at an additional charge.
4. Quotations and Fees
4.1 All quotations are valid for 30 days from the issuance date, unless otherwise stated.
4.2 London EV Chargers reserves the right to withdraw or modify any quotation before it has been accepted by the Client.
4.3 Fees may be subject to additional charges if unforeseen work or delays occur due to factors outside the Company’s control, including:
– Changes in Client requirements.
– Structural or electrical issues discovered on-site.
4.4 The Client will be informed of any additional charges before commencing additional work.
5. Payment Terms
5.1 Unless otherwise agreed, a deposit of 50% of the total fee is required before the commencement of any Services.
5.2 Then 45% balance is due during the project and the final 5% due at completion of the Services.
5.3 Late payments may incur an additional fee of 10%per month on the overdue amount.
5.4 London EV Chargers reserves the right to withhold completion certificates, guarantees, or documentation until all outstanding invoices are settled.
6. Installation Standards and Compliance
6.1 London EV Chargers will perform all Services in accordance with current British Standards, including BS 7671 IET Wiring Regulations and relevant industry codes.
6.2 All EV charge point installations will comply with applicable standards and manufacturer specifications.
6.3 London EV Chargers will provide an Electrical Installation Certificate or Minor Electrical Installation Works Certificate, as applicable, upon completion.
7. Delays and Idle Time Charges
7.1 Any delays not directly caused by the Company (e.g., delays caused by other contractors) that result in postponing the installation may be subject to “idle time” charges.
7.2 The Client will be notified in writing of any idle time charges incurred due to delays outside of the Company’s control.
8. Warranties and Guarantees
8.1 London EV Chargers warrants that all Services provided will be free from defects in workmanship for a period of [warranty period, e.g., 12 months] from the completion date.
8.2 Equipment or parts provided by the Company are covered by the manufacturer’s warranty where applicable.
8.3 The warranty does not cover faults caused by:
– Improper use or handling by the Client.
– Tampering or alteration by third parties.
– Environmental factors, such as power surges or flooding.
8.4 Warranty claims must be made in writing within the warranty period, and the Company will assess each claim individually.
9. Limitation of Liability
9.1 London EV Chargers total liability for any claim arising from or related to these Terms and the Services provided is limited to the total fees paid by the Client.
9.2 London EV Chargers shall not be liable for any indirect, consequential, or incidental damages, including loss of profit, business interruption, or damage to other property.
9.3 The Company is not responsible for any damage caused by third-party equipment or installations performed by other contractors.
9.4 Nothing in these Terms shall exclude or limit liability for death or personal injury caused by the Company’s negligence or any liability that cannot legally be excluded.
10. Health and Safety
10.1 London EV Chargers will comply with all applicable health and safety regulations and will take reasonable precautions to ensure the safety of its personnel, the Client, and the public.
10.2 The Client is responsible for ensuring that the site is safe for the Company’s personnel to carry out the Services.
10.3 The Company reserves the right to cease work if health or safety risks are identified on-site.
11. Force Majeure
11.1 The Company shall not be liable for any delay or failure to perform its obligations under these Terms due to circumstances beyond its control, including acts of God, labor disputes, accidents, pandemics, or government actions.
11.2 In the event of a force majeure, London EV Chargers will notify the Client as soon as possible, and both parties shall work together to find an acceptable solution.
12. Confidentiality and Data Protection
12.1 London EV Chargers will handle any personal data provided by the Client in accordance with the Data Protection Act 2018 and GDPR.
12.2 All Client information, including project details, will be kept confidential unless required by law or agreed upon for public use.
13. Governing Law and Jurisdiction
13.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
13.2 Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Asbestos Clause
14.1 In the unlikely event that asbestos is discovered during installation, all work will be halted immediately for safety reasons.
14.2 It is the Client’s responsibility to arrange for the removal of any asbestos by a certified asbestos removal contractor.
14.3 London EV Chargers will not resume work until the Client provides evidence that the asbestos has been safely removed and the site is cleared for continued work.
14.4 London EV Chargers will not be liable for any delays or additional costs resulting from the presence or removal of asbestos on-site.
This additional clause covers the asbestos handling procedures and clarifies the Client’s responsibilities, ensuring that the discovery of asbestos does not hold the Company liable for delays or added expenses.
15. Amendments
15.1 The Company reserves the right to amend these Terms at any time. Changes will be communicated to the Client and will apply to future projects.
